Newy 87.8 FM – A Swansea woman banned from providing NDIS supports is facing civil penalty proceedings in the Federal Court over alleged breaches of her banning order, the NDIS Quality and Safeguards Commission says.
Lynette Peters (Morgan), of Swansea in the Lake Macquarie area, was banned after she was convicted of making fraudulent claims for NDIS supports and services that were never provided.
The banning order was made on 16 December 2024 under the National Disability Insurance Scheme Act 2013, prohibiting her from any activities relating to the direct provision of NDIS-funded supports and services, including support coordination and plan management.
The order took effect at 5:00pm on 1 January 2025, runs for two years to 1 January 2027, and applies in all states and territories.
The Commission alleges Ms Peters knowingly breached the order by providing support coordination services to two NDIS participants between January and March 2025, and attempted to avoid detection by faking service agreements and invoices.
The investigation began after a tipoff. It is the first time the Commission has taken court action over a breach of a banning order, with separate proceedings also commenced against another individual, Synthia Restar.
Commissioner Louise Glanville said "breaching a banning order is a very serious violation."
The Federal Court can impose civil penalties of up to $330,000 per contravention for individuals.
